Notice what happens when the Court constitutionalizes the sexual revolution--contraception, sexual autonomy, abortion, same-sex marriage--as fundamental constitutional rights. We go from toleration to celebration of the new constitutional order.
The next step is to legislate these new constitutional goods and compel others to serve and celebrate them. So, the Little Sisters of the Poor and Hobby Lobby must subsidize contraceptives and abortafacients, Catholic Hospitals and doctors must perform abortions and gender transition surgeries, and Jack Phillips must bake the cake. The new, unenumerated rights are elevated over the old, express liberties protected by the Bill of Rights.
